Dennis Quaid and Family Receive Settlement from Hospital

Posted by SunnyChanel

Dennis Quaid and his wife had quite a scare a little over a year ago. After their twins were born they were given a dangerous overdose of Heparin, the blood thinner that was administered to the newborns. Lucky, the twins recovered undamaged. Needless to say, the Quaids sued. They went after the maker of the Heparin blaming bottles that were poorly labeled. Although they sued the pharmaceutical company,  Cedars-Sinai Medical Center, the hospital where the babies were born took responsibility.  Yesterday, the Quaids reached a settlement with the hospital at the tune of $750,000. The hospital isn’t actually admitting wrongdoing and the Quaids can still “pursue claims for the children”.

Sadly, there are a scary amount of hospital errors in dealing with newborns and infants.  One issue is the difference in quantities to give and adult vs. babies, others are just plain old mistakes, human error striking again.  Most families don’t have the resources to follow up with a lawsuit in cases like this. The Quaids were lucky enough to demand some consequences, something that needed to be addressed since there were several patients there who were also given an overdose.

Do you think that the hospital settled the case due to its’ high profile nature?

I am very happy for the Quaid Family.  No one should have to endure what they have gone through.

Unfortunately it happens more than the public would imagine, and people need to be aware that it NEVER ends with a hospital settling out of court even though NO LAWSUIT has been filed!  This is purely about Damage control and knowing that an A-list celeb has the money and media power to fight back in a way that the average person does not.  8 out of 10 legitimate malpractice victims in the state of California are unable to get attorneys to even take their case due to a 1975 medical malpractice damage cap of $250,000.  (The MICRA Cap, see www.AmendtheCap.com )

I would like to know if the same settlement was made to the forgotten family of the OTHER CHILD INVOLVED!

CONGRATULATIONS TO THE QUAIDS and to Cedars too for doing the right thing....At least in this high-profile case.

I agree that they settled because of the media attention.

My first question when I heard this was - why was adult-dose heparin even being stored in the NICU? I can understand someone making a mistake when they are rushing to get medication to a newborn. The solution lies in the systems the hospital uses to lessen the impact of human error. Unfortunately, often hospitals don't have the money to install such systems, so it is a never-ending cycle.

Hopefully, the media attention in this case will serve a bigger purpose.  When situations like this are brought to the public's attention, there will not only be more awareness, but likely more precautions taken by those in control of these particular hospital systems.
