Gossip Girl’s Kelly Rutherford Hires Private Eye to Spy on Husband

The nasty court battle between pregnant Gossip Girl Kelly Rutherford and her soon-to-be ex-husband Daniel Giersch continues on. The estranged couple are fighting over their 2-year-old son, Hermes, and Kelly even hired a private investigator to video Giersch, saying that their son is in danger.

Kelly, 40, says that Giersch leaves the cover off the swimming pool, incredibly dangerous with a little child running around. “Hermes is very young,” Kelly said in court documents. “He’s very active, not water safe, and in a moment’s notice, could fall into the swimming pool.”

Video footage gathered over 3 days proved that the pool was definitely uncovered during that time, though nothing “egregious” was seen in the video. “Hermes is not in any danger whatsoever with regard to my pool,” Giersch says, “because I have the pool fully coverd with an automatic pool cover. Hermes has no access to the pool area unless I take him to the pool myself.”

Nevertheless, Giersch has been ordered by the court to keep the pool covered at all times unless he’s nearby.

Another hearing tomorrow covers Hermes’ potty training. I’m not even kidding. They’ll be discussing whether it’s too stressful for Hermes to try potty training while his parents are fighting over divorce and custody. These are the crucial things that tie up the court system in America, folks.

And during all of this, Kelly is pregnant with another baby, a girl, the second child for her and Daniel. She’s due in about 3 weeks, too. I say Hermes will still be wearing diapers in 3 years.
