8-year-old Daniel D’Attilo and his family were awarded a total of $58 million dollars in a malpractice suit against the obstetrician who delivered him. The malpractice suit is being called the largest medical malpractice verdict in the state of Connecticut’s history.
Lawyers argued that Daniel’s mother, Cathy D’Attilo’s doctor failed to deliver her son early, despite complications. When Daniel was finally delivered via c-section – it was done improperly, cutting the oxygen off to Daniel’s brain. Daniel suffers from cerebral palsy because of the brain damage. He cannot speak, eat or walk and requires constant care.
“The dollar amount means he will be taken care of, that’s what this means to us,” Cathy D’Attilo said.
“He got his life taken away from him, and the only form of justice is this,” said Dominic D’Attilo, Daniel’s father.
The $58 million verdict includes $8 million for Daniel’s past and future medical bills, and $50 million for pain and suffering. Unfortunately, because of appeal processes it will likely be years before Daniel and his family see any money. His family is currently undergoing foreclosure due to the mounting medical bills. They are hoping to be able to remain in the house and keep Daniel comfortable.
